Summary/Abstract: This article examines the relationship between freedom of expression and liability for third-party comments in the online environment with focus on the judgment delivered in Pătraşcu v. Romania by the European Court of Human Rights, reffering to the standards applicable to digital platforms and individual social media users. The article argues that the Court’s recent case law reflects a tendency to limit the automatic extension of liability for user-generated content and to strengthen the protection afforded to online expression, particularly in the context of public-interest debates. It further highlights that the balance between the protection of reputation and freedom of expression in the digital environment depends on the establishment of clear, foreseeable, and proportionate standards compatible with the requirements of Article 10 of the European Convention on Human Rights.
