Summary/Abstract: The essential problem regarding this case concerns the ballance between the necessity of respecting the principle of mutual recognition of the court decisions established by the Framework Decision 2002/584/JAI on one side, and the rigors of the necessity to respect the fundamental rights established in the Charter of Fundamental Rights of the European Union and by the Convention for the Protection of Human Rights and Fundamental Freedoms (EHRC) on the other side, in the context of the execution of an European arrest warrant.
