Summary/Abstract: This study analyses the unique and multifaceted nature of concubinage, a form of de facto partnership under French law, highlighting how its vague legal contours are reflected in legal practice. It demonstrates how gaps in the regulatory framework prompt courts to adopt creative, case-by-case solutions, as well as a broader tendency toward outcomes that often resemble those applied in marital contexts, albeit not automatically. The analysis underscores the duality of French law, which seeks to balance respect for individual autonomy with a subtle, sometimes even moralising judicial effort to achieve equitable resolutions following the breakdown of the relationship.
