Summary/Abstract: The article pertains to the contract for passenger transport in Roman law as it examines the different types of transportation. It focuses on the contrast between some forms of passenger transport which were legally regulated, such as maritime transport of passengers and can be considered as lex and those forms of transport which were not strictly regulated but existed nonetheless, such as travel by land and therefore can be argued to be ius. This analysis aims to show the duality in the legal nature of the contract for transport of passengers.
