Summary/Abstract: Custom is, par excellence, the source of law closest to the evolution of a society. We begin our comparative-historical journey with the etymology of custom, analysing its applications in various branches of law, and we will try to highlight the essential role of mos majorum or boni mores in the development of customs. We aim to highlight the role played by this source of Roman law in the development of modern law and to outline the influence of Roman customs on the continental civil law system, as well as their contribution to the shaping of modern legal principles.
