Summary/Abstract: The question of popular procedural legitimation and its role in the administration of justice is a central issue in the conception of the State, especially in certain historical stages, such as the Roman, given its intimate connection with the concepts of citizenship and sovereignty. Popular actions have their origin in classical Athens, and their development in the Roman Republic, in which actio popularis is exercised in defence of public or general interests, pro populo.
