Summary/Abstract: The article examines Romanian migration to Germany and Italy in the COVID-19 to today context, highlighting the gap between formal EU citizenship rights and migrants lived experiences. Through comparative analysis, it exploreshow different national government frameworks influence the effectiveness of social innovation in promoting social inclusion. Based on a capacity-based approach, the study highlights how institutional capacity and policy coherence determine whether social innovation can act as a transformative mechanism for the realisation of rights. While Germany demonstrates a coordinated and institutionalized approach,Italy highlights the limits of fragmented and bottom-up initiatives. The study supports creating a rights based system of migration at the level of Europe; social innovation should become integrated into rationalized and effective governance mechanisms to create substantive equality and inclusion among all participants within such systems.
