Summary/Abstract: In the light of the provisions of art. 1326 para. (3) of the Civil Code, the fact that the appellant did not come to the post office to pick up the correspondence, even if for reasons which cannot be attributable to it, shall not remove the effect of the service of the respective document. Decision no. 10/2013 of the High Court of Cassation and Justice and decision no. 1254/2011 of the Constitutional Court state in respect to a different assumption, respectively the service of a document by a state body towards an offender who is a natural person.
