Summary/Abstract: This case note examines a legal question of genuine complexity, situated at the intersection of succession law, the general theory of juridical acts, and civil procedural law: whether the annulment of a certificate of inheritance may entail, by operation of the principle resoluto iure dantis resolvitur ius accipientis, the absolute nullity of a subsequent donation agreement, through the application of the donatio rei alienae doctrine. The appellate courts resolved this question in the negative, holding that a certificate of inheritance is a purely declaratory act whose annulment produces exclusively evidentiary effects, without extinguishing the donor's right of ownership, which subsists on the basis of an independent title – a contract of sale concluded in 1991, read in conjunction with the presumption of community of property established by (former – n.n.) Article 30 of the Family Code. The note approves the solution in its substance, while identifying certain argumentative inconsistencies, particularly with respect to the analysis of the plea of lack of standing to sue and to the confusion – recurrent in the reasoning of the courts – between the conditions of admissibility of a civil action and the examination of the merits.
