THE ISSUE OF CRIMINAL LIABILITY OF LEGAL PERSONS IN CASES OF ILLICIT DRUG TRAFFICKING AND USE

Summary/Abstract: The topic of the criminal liability of legal entities for acts related to drug trafficking is of particular importance and relevance. In a context where organized crime – and, implicitly, drug trafficking – is carried out through seemingly lawful economic fronts, the criminal liability of legal entities becomes an indispensable instrument in the fight against criminal activity. However, practice has shown that this topic raises numerous issues regarding the understanding of the context in which legal entities are involved in such activities and the manner in which their criminal liability is engaged, a fact best reflected by the relatively small number of cases in which this legal institution is applied.
