Summary/Abstract: This research will analyze the current legal framework governing data protection and cross-border data transfers from both the European Union and United States perspectives, with a particular focus on the GDPR and relevant legislation. It will examine how these rules facilitate or hinder data transfers between the EU and the US for entities with European connections. The study will identify the main challenges and benefits in order to enhance understanding of data protection in an international context. The findings will contribute to international debates and have implications for legal practitioners, businesses, and policymakers interested in cross-border transfers within the global digital economy. The General Data Protection Regulation (GDPR), which entered into force on 25 May 2018, has significantly transformed European data protection law. It serves as the cornerstone of data protection legislation in the EU and establishes requirements for the processing of personal data by controllers and third parties, such as clinical trial sponsors. The legislation is based on key principles designed to ensure that the processing of personal data respects the rights and freedoms of data subjects, is carried out lawfully and transparently, and takes into account their legitimate concerns. In essence, all entities that process, store, or transfer data relating to identifiable individuals must comply with this legislation.
