A COMPARATIVE ANALYSIS OF KVKK AND GDPR IN FINTECH AND E-WALLET SERVICES

Summary/Abstract: This study comparatively examines the regulatory approaches of the European Union’s General Data Protection Regulation (GDPR) and Türkiye’s Personal Data Protection Law No. 6698 (KVKK) in fintech sector, focusing on e-wallet services. As personal data protection has become essential for legal compliance and operational sustainability, the research employs a comparative legal methodology to analyze GDPR and KVKK provisions on an article-by-article basis. Furthermore, a qualitative case study is conducted using selected e-wallet providers operating in Türkiye. The study contributes to literature by extending beyond a purely normative comparison and evaluating the practical implications of both frameworks within the fintech industry through case analysis. The findings indicate that GDPR and KVKK share fundamental data protection principles, including lawfulness, data minimization, and data security. However, notable differences exist regarding regulatory scope, data subject rights, enforcement mechanisms, and sanctions, which may influence compliance requirements and operational practices among e-wallet service providers in Türkiye.
