Summary/Abstract: This study discusses the issue of unpaid leave. The author’s aim is to present the legal regulation in force and draw conclusions and postulates for future changes in this area. To this end, a research question is asking whether the current legal regulation favors the use of unpaid leave in practice without any legal problems. In the author’s opinion, today’s laws on unpaid leave are insufficient and raise doubts not only in legal commentary but also in the practical application of this exemption from the employee’s obligation to perform work. The issue of granting, enjoying and canceling unpaid leave and its consequences for the employee is discussed. The research methods include investigation of the law in force and deductive reasoning.
