Summary/Abstract: The paper focuses on the problem of violation of the rules of caution in the structure of an unintentional crime. I present the historical development of the regulation addressing the issue in question in the series of Polish criminal codes of the twentieth century, before moving on to an analysis of Article 9(2) of the currently binding Code. This analysis allows a conclusion that an unknowing breach of the rules of caution may constitute grounds for criminal liability, but – contrary to the majority view of legal scholars and commentators – this will not be the case each time. Indeed, when assessing the subjective side, foreseeability cannot be limited solely to the criminal effect. It should also include the breach of the precautionary rules.
