II. STUDIES, ARTICLES, OPINIONS MAINTENANCE OBLIGATION TO SUPPORT MINOR CHILD – DETERMINING THE AMOUNT IN THE CASE OF A DEBTOR PARENT WHO LIVES ABROAD AND DOES NOT HAVE DECLARED INCOME

Summary/Abstract: In recent years, we have witnessed an increasingly widespread phenomenon of labor migration to other countries. However, this social and economic reality generates certain problems in the field of family law, and in this case we refer to the situation of establishing the maintenance obligation owed to a minor child by a parent residing in another country who earns income but does not declare it. At the level of national courts, such disputes have received inconsistent solutions, which is why finding a formula for standardizing judicial practice has been a point of interest at the level of the National Institute of Magistracy. We propose that this study be dedicated to analyzing the solutions pronounced to date, as well as how these disputes are expected to be settled in the future, as this is a topic of real interest.
