Summary/Abstract: The study examines the European Commission's Digital Fairness Act proposal in light of the information disclosed to the public. Among other things, it comes to the conclusion that the parallelism between the UCP and the DSA does not appear to be such an insurmountable problem based on the EU Court's case law on ne bis in idem that it would necessitate the centralisation of consumer protection competences. Based on two Hungarian cases (TikTok and Microsoft), the study illustrates that the possible centralisation of competences may adversely affect consumer protection in Member States that take national perspectives such as child protection and language aspects into account. The study finds that this is also problematic in view of the principle of subsidiarity.
