Summary/Abstract: The Court of Justice of the European Union delivered its judgment in Case C‑492/23, Russmedia (Publi24), ruling that the operator of an online marketplace qualifies, under Regulation (EU) 2016/679, as a data controller with respect to the personal data contained in the advertisements published on its platform. Consequently, the operator must identify, prior to publication, advertisements that contain sensitive data and verify whether the author of the advertisement is indeed the person whose data appear in the ad, or whether the author has obtained that person’s explicit consent.
