ACTIONS IN ADMINISTRATIVE LITIGATION REGARDING THE CANCELLATION OF NORMATIVE ADMINISTRATIVE ACTS. PRACTICAL CASES

Summary/Abstract: Through this article, by analyzing two cases, we set out to highlight, on the one hand, the important role of practice in relation to theory, but on the other hand, their indissoluble and homogeneous combination, as the two elements forming an inseparable, monolithic whole. The first case analyzed reveals the idea that inequity itself, as a concept, is not sufficient to lead to the annulment of a normative administrative act, as long as it does not specifically violate any legal norm contained in a normative act with superior legal force. The second case analyzed demonstrates the need to understand the meaning of the primary legislation in order to be able to distinguish whether or not, there is any contradiction between it and the contested administrative act, issued under the primary legislation.
