Selected issues relating to a conclusion of residential lease agreements for apartments constituting the commune's housing stock

Summary/Abstract: The Act on Municipal Self‑Government prohibits heads of communes, town mayors, town presidents, deputy heads of communes and councillors, as well as their spouses and domestic partners, from concluding residential lease agreements with regard to apartments that form part of the housing stock of the commune where they perform their duties or were elected as councillors. The opinion describes exceptions to this rule. Neither the referred Act nor the Electoral Code explicitly specifies the consequences of violating this prohibition, although an agreement concluded in violation of the prohibition should be considered invalid.
