Summary/Abstract: The rules of cooperation resulting from the franchise agreement (regulated by the provisions of the Civil Code) differ significantly from an employment relationship under labour law. It is not possible to directly transfer labour law solutions to relations based on franchise agreements. However, it should be considered whether franchisees could be better protected by applying certain legal mechanisms provided in labour law or constructions similar to them, for example in order to ensure freedom of work, limit the financial liability or regulate the terms of non-competition agreements. The possible introduction of specific legal regulations concerning franchisees and their employees should also be considered from the perspective of the constitutional principle of equality.
