Summary/Abstract: In the draft position of the Sejm on the constitutional complaint, it was requested that the provision of the Family and Guardianship Code - to the extent that it limits the right of a divorced spouse found to be jointly responsible for the breakdown of the marriage to claim maintenance only to circumstances where the spouse is in need, to an extent corresponding to the justified needs of the entitled person and the earning ability and financial capabilities of the obligated person - conforms to the Constitution.
