Summary/Abstract: The study attempts to answer the question of whether, de lege lata, in the Polish legal system, a school statute may introduce a total ban on the use of mobile phones by students on school premises. Selected threats resulting from the inappropriate, including excessive, use of mobile phones by children and adolescents, which could justify a ban on their use at school, were presented. Attention was drawn to the fact that the provision introducing such a prohibition constitutes significant interference with the right to property. For this reason, it was considered whether the provisions introducing the described restrictions in the school statute comply with the conditions for the admissibility of restrictions on constitutional rights and freedoms, as set out in Article 31 para. 3 of the Constitution of the Republic of Poland.
