Summary/Abstract: There is no general and comprehensive legislation governing the construction of shooting ranges. The classification of a given facility as an open shooting range and as a building structure is a matter for a court to decide on a case-by-case basis. A shooting range classified as a building structure is subject to the rules of construction law, which means, among other things, that a building permit must be obtained. No provision explicitly regulates the possibility (or impossibility) of carrying out an investment in the form of an open shooting range in a protected landscape area. However, due to the specific nature of the area in question, which is a form of nature protection established for the purpose of landscape protection, the freedom of property owners to manage real estate located in this area and to locate buildings on it is limited.
