Possibility of excluding a councillor from voting on a municipal council resolution

Summary/Abstract: In the situation under analysis, the fact that the councillor's wife is employed as a teacher at the school does not determine the necessity to exclude the councillor from voting on the resolution concerning the closure of that school. It does not seem possible to answer the question of the degree of kinship or affinity justifying the exclusion of a councillor from voting on a municipal council resolution. The existence of kinship relationship or affinity does not mean that there is a legal interest on the part of a councillor, which is the reason for excluding the councillor from participating in a specific vote.
