Summary/Abstract: The article analyzes the possibility that the subject of constitutional review, upon a request by a judicial panel in connection with a specific case (Article 150, paragraph 2 of the Constitution), may include not only a law currently in force but also a repealed law, when such a law constitutes applicable law in the respective case. Arguments are presented that this possibility stems from the need to ensure the supremacy of the Constitution in the administration of justice, with the proviso that the law must belong to the category of laws that are required to conform to the current Basic Law – either adopted during its validity or in force at the time of its entry into force.
