Summary/Abstract: The article addresses the problem of potential concurrence between the crime defined in Art. 158(1) of the Penal Code and that in Art. 254(1) of the Penal Code. Seemingly, these acts protect different legal interests, and the behaviors penalized by these provisions are delineated differently. However, in judicial practice, the issue is more complex. This complexity arises from the broad interpretation of the characteristics of participation in a fight (beating), which closely resembles characteristics of the crime of participating in a crowd. Therefore, the article aims to present the differences between these acts.
