Summary/Abstract: The subject of this analysis is the examination of the case law of administrative courts in the matter of determining the scope of the obligation to transfer documentation by an entity running a pharmacy, in the light of concern about the correct interpretation of Article 37at(8) of the Pharmaceutical Law in accordance with constitutional principles and values. In this context, the question arises about the potential necessity of determining the unconstitutionality of the provision in question due to the violation of the principle of specificity of law and the intervention of the legislator. This also allows for some reflections not only on the observance of the principles of proper legislation by the legislator, but also on how public authorities interpret the regulations governing economic activity in the pharmacy market from the perspective of adhering to constitutional principles and values.
