Summary/Abstract: In any country, public law arouses interest due to its specific regulatory framework, which makes any interested person seek to better understand its operational mechanisms, because the applicability of this huge branch of law is broader than that of private law. At the same time, public law is the area where history, politics, economics, and other characteristics of nations manifest themselves powerfully, because the typology of specific legal norms concentrates a part of every citizen's will for the better. Romanian public law is no exception to these fundamental frameworks of operation. However, the historical path that the Romanian nation has had in the last two centuries – but especially after 1859 – has brought into discussion several aspects, which were neither linear nor common to all countries on the European continent. The space that public law scholars and practitioners had to occupy in Romanian society was vast, because they had to contribute perhaps more than other specialists to the construction of a state that changed its territory and political regime several times. The major transformations the country underwent happened rapidly, which forced lawyers specialized in public law to act not always after periods of reflection, but rather based on realities and positive law, entrusting paper with part of their own plans for organizing the state, without, however, having the opportunity to implement them from suitable public positions. From these reasons the text we propose is a synthesis of historical and legal realities, constantly keeping in mind the perspective of its development into a volume.
