Summary/Abstract: The issue of criminal responsibility for the crime of state treason committed during the struggle for the eastern border in the territory east of the former Congress Kingdom of Poland, which in 1919-1920 was covered by the Civil Administration of the Eastern Territories, was one of the problems which the Polish judicial system faced in the first years of the Second Polish Republic. The Supreme Court, in its judgements in such cases, referred to the concept of the continuity of the Polish state, which led to the adoption of an extensive interpretation that was unacceptable in criminal law. This indicates that, in fact, the Supreme Court aimed at satisfying the social sense of justice rather than strictly following the provisions of the law. however, some judgements indicate that the Supreme Court adopted a slightly different approach, and thus the assessment of its jurisprudence in this matter remains ambiguous.
