Summary/Abstract: The accelerated development of new virtual technologies, and in particular of artificial intelligence, gives rise to major legal challenges for the traditional system of intellectual property law established by the Berne Convention for the Protection of Literary and Artistic Works and the Paris Convention for the Protection of Industrial Property. The ability of artificial intelligence to generate texts, images, music, or other forms of content comparable to those created by humans makes it necessary to reassess certain fundamental concepts of copyright law, such as authorship, originality, and ownership of rights. In this context, the European Parliament adopted the report on copyright and generative artificial intelligence – opportunities and challenges, based on the report on protecting the European Union’s creative production in the age of artificial intelligence, drafted by Member of the European Parliament Axel Voss. This article analyses the context in which the aforementioned report was developed and the principles arising from its content, highlighting the tension between the need to foster technological innovation and the need to protect creators and rights holders, as well as to maintain the economic sustainability of European cultural industries.
