The Right to a Fair Trial within the Meaning of Article 6(1) of the Convention for the Protection of Human Rights and Fundamental Freedoms – Selected Issues Key to Understanding the Convention Standard in the Field of Taxation

Summary/Abstract: The purpose of this article is to reconstruct and systematise the normative content of the Convention standard concerning the right of access to a court (the right to a fair trial) and to identify the elements of that standard which are relevant in the field of taxation. This issue is of particular importance, as the Convention standard constitutes one of the key benchmarks for assessing national procedural frameworks in terms of their compliance with the requirements of effective judicial protection and procedural guarantees afforded to individuals.
