Summary/Abstract: After 23 years of cohabitation and the birth of three children, the man filed for a declaration of nullity of marriage. He cited his wife's inability to fulfill essential marital duties as the basis. The positive ruling of the court of first instance was confirmed by a decree of the Tribunal of the Apostolic Nunciature in Spain. The woman disagreed with the rulings of both the first and second instance courts. She requested a reconsideration of the case. She argued that neither neurosis nor emotional immaturity, for which she had been accused, had been proven. Consequently, the Tribunal of the Spanish Rota positively resolved her request for a new case to be filed based on can. 1644 of the Code of Canon Law.
