The generic content of the principle of presumption of innocence

Summary/Abstract: In order to identify the functions that one element can perform in relation to another, it is necessary to know the properties of both elements. Therefore, in order to identify the prerogatives vested in Romanian judges to guarantee the right of the accused to be presumed innocent, it is necessary to outline the content of the principle of presumption of innocence. As such, we will now present, in a concise manner, how the presumption of innocence is understood in the case law of the European Court of Human Rights (ECHR) and the Court of Justice of the European Union (CJEU), as well as in Romanian legal theory and practice.
