Summary/Abstract: A chronological review of the development of labor law as a branch of law demonstrates that guarantees concerning occupational safety and health evolved gradually over time. However, the passage of time was not the sole, nor even the decisive, factor shaping these guarantees. Instead, they emerged through the struggle of workers for their rights and for adequate working conditions. Over the years, the concept of occupational safety and health has developed and expanded its scope. Whereas protection in this field long referred (solely) to safeguarding physical health, a holistic approach has now been broadly accepted, encompassing the protection of workers’ physical, psychological, and moral integrity. In this light, the aim of this paper is to highlight the importance of labour law in safeguarding mental health at work. This issue is examined within the broader context of the contemporary world of work and the diverse factors that directly and indirectly affect mental health in the workplace. Particular attention is devoted to labour legislation in the Republic of Serbia, in view of the adoption of a new Occupational Safety and Health Act in 2023, as the provisions of this act are analyzed from the perspective of protection, i.e., lack of protection of mental health at work.
