Summary/Abstract: In Serbian legislation, the right to assistance and care by another person is defined as a right to material support (in the form of monetary and non-monetary benefits) within the framework of social law. The exercise of this right is regulated by the Law on Social Protection and the Law on Pension and Disability Insurance. Consequently, the right to assistance and care by another person can be realized on two different grounds, within two distinct systems – the system of social protection and the system of pension and disability insurance. In addition, Serbian legislation provides for a separate system in which this right is recognized for war veterans, military and civilian war invalids, or their family members. This is the system of veterans’ and disability protection, governed by the Law on the Rights of Veterans, Military Invalids, Civilian War Invalids and Their Family Members, which regulates the right to assistance and care by another person exclusively for its beneficiaries, and only in the form of monetary allowances. This means that, depending on the category to which an individual belongs, the right to assistance and care by another person in the Republic of Serbia is defined and recognized by as many as three laws, within three different systems. In view of the complexity of this framework, the author has chosen to analyze the regulation of the right to assistance and care by another person within the system of veterans’ and disability protection, considering that this system deserves greater attention from both academic and professional audiences. The central aim of this paper is to examine the manner in which the right to assistance and care by another person is regulated within the veterans’ and disability protection system, with particular focus on its specific characteristics, including the types of rights granted to persons dependent on the assistance and care of others under this system, the conditions for their realization, the procedures for the exercise and protection of such rights, as well as the competent authorities responsible for decision-making.
