Summary/Abstract: The principle of equality and equity, on the one hand, and the principle of prohibition of discrimination, on the other hand, constitute two of the several fundamental principles of the employment relationship, while pay is one of the fundamental elements of the employment relationship. Male and female workers have a fundamental right to equal pay, not only for equal or similar work, but also for work that is completely different but of equal value. Unequal pay between men and women is a problem that is difficult to overcome if the basic concepts are not understood and thus, unequal pay constitutes sex discrimination. Taking into consideration that the principle of equal pay seems complex at first glance, and the Macedonian Labour Relations Law contains only a few provisions regulating equal pay for men and women, in addressing these concepts the authors analyze primarily the provisions of the first international legal instrument on this issue, i.e. the fundamental Equal Remuneration Convention of 1951 (No. 100), as an integral part of the domestic legal order, and the Surveys of the Committee of Experts on the Application of Conventions and Recommendations of the International Labour Organization.
