II. VARIA About the good performance guarantee provided by the awarded contractor within a public procurement procedure

Summary/Abstract: This article analyses the legal regime governing the good performance guarantee provided by the successful tenderer following the signing of a public procurement contract, especially in terms of the legal relationship between the latter and the contracting authority . Based on the special legal framework and the guidelines issued by The National Agency for Public Procurement, several practical aspects will be highlighted to help economic operators understand their rights and obligations, as well as the implications of non performance or poor performance of contracts from the perspective of the guarantee provided.
