On certain instances of forfeiture in primary real rights

Summary/Abstract: The delimitation of the subject matter of this study requires two clarifications. First, in order to ensure clarity of presentation, it is necessary to opt for a specific meaning of the concept of forfeiture (nr 2). In this principal sense, the concept of forfeiture will be used throughout the text. Second, not all cases of forfeiture in the field of primary rights will be examined, but only some of them (II). Based on the analysis of these cases of forfeiture, several considerations will be formulated regarding the correlation between the interest of the holder of the subjective right subject to forfeiture and the interests of other persons, from the perspective of the legal protection of these interests, and certain specific aspects of forfeiture in the field of real rights will be highlighted (III).
