Some aspects of the effect of forfeiture in the context of contesting enforcem

Summary/Abstract: The objection to enforcement constitutes the primary procedural tool through which judicial control is exercised during the enforcement phase. The rules governing enforcement objections have undergone substantial changes over time, which has contributed to uncertainty in judicial practice regarding essential aspects, including the effects of forfeiture of the right to raise criticisms concerning enforcement or enforcement acts. This article does not aim to exhaustively address the issue of forfeiture in the context of enforcement objections, but rather to provide answers to certain aspects that have recently been subject to doctrinal or jurisprudential debate. The importance of the topic is reflected in the fluid nature of enforcement proceedings and in the balance of mechanisms protecting the rights of parties involved in the enforcement process.
