Reinstatement into the time limit for the succession option: an analysis from the perspective of substantive law and procedural

Summary/Abstract: This paper provides an analysis of the institution of reinstatement into the time limit for exercising the right of succession option, examined from both the perspective of substantive law and procedural law. Accordingly, the paper identifies the conditions whose fulfillment ensures the admissibility of reinstatement into the time limit for the succession option, as well as the effects of its admission in the realm of substantive law. At the same time, reinstatement into the time limit for the succession option operates within the framework of civil proceedings, which calls for the correct identification of the procedural means through which it is invoked. Contrary to what might result from an initial analysis, reinstatement into the time limit for the succession option is invoked by way of a defense on the merits, a clarification that facilitates a clearer understanding of the procedural regime applicable to it. It is once again demonstrated that a full understanding of an institution whose affiliation is claimed by substantive law can only be achieved by observing the dynamics of its application within civil proceedings. Since the provisions of Article 2522 of the Civil Code, which govern reinstatement into the limitation period, apply mutatis mutandis to reinstatement into the time limit for the succession option, the paper includes a comparative analysis of the manner in which the legal text must be applied to the two institutions.
