Summary/Abstract: Conducting an in-depth analysis of the actual normative landscape is a key point in using technology safely within the justice system, enjoying its fantastic benefits while offering protection against potential deviations whose severity cannot always be foreseen. This article explores potential legislative gaps in regulating digital progress that may undermine the guarantee of constitutional rights, the sufficiency or insufficiency of the traditional constitutional framework in the face of the digital ecosystem's complexity, as well as legislative excesses that may represent a source of vulnerabilities, requiring a profound rethinking of legal protection. Understanding the rights derived or newly emerged in the digital era, as well as the comprehension and application of new concepts such as digital constitutionalism, represent urgent aspects. Without these steps, the risk of eroding constitutional rights becomes imminent, affecting both individual freedoms and the rule of law. The conclusions aim toward ensuring a harmonious coexistence between innovation and freedom. Adapting the normative framework must become a continuous priority, so that technology retains its inherent purpose of serving society, not subordinating or disrupting it.
