Summary/Abstract: In major international instruments, such as the Declaration of Human Rights (Art. 16), the European Convention on Human Rights (Art. 12) and the International Covenant on Civil and Political Rights Art. 23), whenever principles concerning marriage or the family have been enunciated, reference has been made only to "man" and "woman", and to their status as "parents" in their relationship with their children, i.e. to marriage and the traditional family, as formerly provided for by Jus naturale (Gaius, Institutiones lb. I, I, 3, 9) and Jus civile (Justiniani Digestae, lb. I, I, I, 7). The right to marriage was to undergo an evolutionary process with the emergence of homosexual and transgender couples who had undergone a sex reassignment.
