Summary/Abstract: This research aims to analyse the legislative framework regulating the institution of the “protection mandate”. Starting from the [relatively recent] legislative amendments, we will first analyse the provisions of the substantive law in the matter [concept, substantive and formal conditions, effects, termination methods] and subsequently, we will also observe the procedural provisions regarding the approval of the protection mandate. We will conclude the analysis by observing the necessity and usefulness of the regulations, in relation to the legislative amendments made in the sphere of the protection of persons with intellectual and psychosocial disabilities. In carrying out this research, the legal provisions in force were mainly analysed, but also the opinions of specialists transposed into the existing specialized doctrine in the matter.
