Summary/Abstract: The expansion of digitalization and the intensive use of personal data have prompted a reassessment of the existing legal framework, highlighting the tension between legislative voids and regulatory excess. In this context, the right to be forgotten and the right to informational self-determination have become essential tools for protecting individual autonomy in the online environment. However, the implementation of these rights faces challenges related to regulatory fragmentation, the effectiveness of enforcement mechanisms, and the impact on the freedom of information. This paper analyzes how these rights are enshrined in European and international law, emphasizing the need for a balance between data protection and technological innovation. In an ever-evolving regulatory landscape, adaptability and coherence of regulations are crucial for ensuring an efficient and sustainable legal framework.
