Summary/Abstract: On December 6, 2024, the Constitutional Court annulled the entire electoral process regarding the election of the President of Romania in 2024, based on the declassification by the CSAT on December 4, 2024 of the content of the "Information Notes" received from the SRI, SIE, MAI and STS., which determined numerous attitudes and controversies among Romanian jurists, the attribution of the constitutional court to oversee compliance with the procedure for the election of the President of Romania and to confirm the results of the vote being interpreted in various ways. In exercising this power, after the declassification on December 4, 2024 of the documents presented at the meeting of the Supreme Council for National Defense on November 28, 2024 and their public disclosure, the Constitutional Court took note of their content, finding that the electoral process regarding the election of the President of Romania was flawed throughout its duration and at all stages by multiple irregularities and violations of electoral legislation that distorted the free and fair nature of the vote expressed by citizens and the equality of opportunity of electoral competitors, affected the transparent and fair nature of the electoral campaign and disregarded the legal regulations regarding their financing. All of these aspects had a converging effect of disregarding the essential principles of democratic elections. The freely expressed nature of the vote was violated by the fact that voters were misinformed through an electoral campaign in which one of the candidates benefited from aggressive promotion, carried out in circumvention of national electoral legislation and through the abusive exploitation of social media platform algorithms. Also, the documents declassified by CSAT say that actions by a state cyber actor have taken place on IT&C infrastructures supporting the electoral process and that Romania is a target for aggressive hybrid actions.
