Summary/Abstract: The digitization of commerce has significantly changed the legal relationship between professionals and consumers; bringing to the fore new challenges related to the scope and content of the information obligation; as well as the ways in which the consumer is protected in online contracts. This article aims to analyze the nature of the legal liability of the e-commerce professional; focusing on the interaction between the information duty and the consumer's right to fair terms; transparency and certainty. By examining European and national legislation; relevant case law and doctrinal views; the study highlights the legal consequences of failure to comply with the duty to inform; as well as how consumer protection mechanisms contribute to maintaining a real balance of contractual interests. At the same time; the approach combines normative analysis with case law to provide a coherent theoretical and practical framework appropriate to the realities of the digital market.
