Summary/Abstract: Since digital evolution has brought both opportunities and dangers, the natural question arises: is society prepared for this phenomenon?Of course, the advantages are multiple, ultimately translating into the notion of a higher standard of living. Among the major issues raised, however, by this digital evolution, which is a constant and topical concern among specialists at an international level, is that of criminal liability in the field of AI, although the influence on the human factor cannot be neglected either. Who and, above all, how will be responsible for any damage caused by the latter?
