Summary/Abstract: The article presents the basic theses that make up the philosophical-legal concept laid out after World War II by Gustav Radbruch, with particular emphasis on the idea of so-called statutory lawlessness. In particular, the authors address the nature of modern positivism and its relationship to legal-natural concepts. They then discuss practical examples of the application of G. Radbruch's thought in the decisions of selected tribunals established in the 2nd half of the 20th century to try crimes against humanity. The authors show that the mere fact of appealing to extra-legal values does not conflict with contemporary positivism. Moreover, the correlation of state law with axiology is inherent in contemporary dominant legal-positivist concepts.
