Summary/Abstract: The criminal evidence represents the totality of the actions undertaken by the competent state bodies in orderto establish the circumstances of the case. Judicial expertise, within the criminal evidence, is an evidentiary procedure in whichthe forensic expert conducts research and formulates conclusions regarding certain circumstances, facts, objects, etc. The resultsof this activity are materialized by the forensic expert in a forensic report, which is a means of proof in criminal proceedings.At the disposal of the forensic examination, the authorizing officer is obliged to take certain actions that allow the suspect,the accused or the defendant to defend his interests by methods and means not prohibited by law, these obligations arise fromboth legal provisions RM.
