Summary/Abstract: This article constitutes an attempt at addressing doubts about the constitutionality of rendering the administration of certain preventive vaccines as an obligation of a legal nature. The article comprises the presentation of direct and indirect normative grounds for the compulsory preventive vaccination of children, as well as a discussion of the constitutionality of the restriction of certain civil rights and freedoms by the introduced obligation. An examination of relevant legal provisions is followed by an analysis of the jurisprudence (i.e. case law) of administrative courts. The purpose of this article is to determine whether the introduced obligation of compulsory preventive vaccination complies with the Constitution of the Republic of Poland, in terms of the legal construct of the said obligation and the proportionality of the impact of the ensuing restriction of citizens’ constitutional rights and freedoms.
